Welcome to SiteRecord. These Terms of Use ("Terms") govern your access to and use of the SiteRecord compliance management service ("Service") provided by SiteRecord ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
SiteRecord provides a web-based compliance management platform that allows users to:
- Register and manage websites for compliance monitoring
- Run automated accessibility and compliance scans
- View, track, and manage compliance findings
- Generate and maintain compliance records
- Document remediation efforts and evidence
3. Account Registration and Security
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring your contact information remains current
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service to scan websites you do not own or have authorization to scan
- Attempt to gain unauthorized access to any part of the Service or its systems
- Use the Service to transmit malware, viruses, or other harmful code
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated means to access the Service except through our provided interfaces
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service in any way that violates applicable laws or regulations
- Resell, sublicense, or provide access to the Service to third parties without authorization
5. Intellectual Property
The Service, including its original content, features, and functionality, is owned by SiteRecord and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.
You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of providing the Service to you.
6. Compliance Scanning and Results
Scan Authorization: By adding a website to the Service and initiating a scan, you represent and warrant that you have the legal right and authorization to scan that website.
Scan Limitations: Our compliance scans are automated tools designed to identify potential accessibility and compliance issues. They are not a substitute for professional accessibility audits, legal advice, or manual testing.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
8. Service Availability and Modifications
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may:
- Modify, suspend, or discontinue any part of the Service at any time
- Perform scheduled or emergency maintenance
- Update features, functionality, or user interfaces
We will make reasonable efforts to provide notice of significant changes or scheduled downtime when possible.
9. Fees and Payment
Certain features of the Service may require payment. If you subscribe to paid features:
- You agree to pay all applicable fees as described at the time of purchase

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SITERECORD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify, defend, and hold harmless SiteRecord and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any content you submit to the Service
13. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and associated data, subject to our data retention policies
- Provisions of these Terms that by their nature should survive termination will survive
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive relief in any court of competent jurisdiction.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
16. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SiteRecord regarding the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
